Terms and Conditions

Contest: The Organization for Social Media Safety is holding an annual contest to give students the chance to educate the world on the importance of social media safety  

Contest Entries: Entries must be original works, in either written or video form, that illuminate any aspect of social media safety. The winner will receive a prize of $2500. The contest is open to entrants (“Entrants”) who are legal residents of the 50 United States and Washington, D.C. Void outside of the 50 United States, Washington, D.C., and where prohibited. Entrants must be between 13 and 22 years of age and have Internet access, as of the date of submission. The winner is responsible for all taxes associated with the receipt of the prize. As a condition of receiving the prize, the winner must submit a completed W-9 to the Organization for Social Media Safety (the “Organization”).

Submission: Deadline for entries is 11:59 p.m. PDT December 31, 2021. The Organization will accept only one entry per individual. Entries for Entrants under 18 may be submitted only with the express consent of the Entrant’s parent or guardian. In the event that two or more Entrants submit substantially the same entry (for example, where multiple Entrants have collaborated on one entry), the first of these Entrants to submit an entry shall be the only Entrant among them eligible to win the Contest. Entries must be submitted via the Dropbox file request link provided by the Organization for Social Media Safety. The Organization is not responsible for errors in transmission, computer errors, or similar problems. The Organization will be the sole judge of an entry and Entrant’s eligibility.

Winner: Contest entries will be judged by the staff of the Organization. All decisions are final. Entries will be judged based on impact, engagement, and contribution to the field of social media safety. The winner will be notified on or before February 1, 2022. The winner will be notified by email prior to any public announcement. If the winner does not respond within five business days, or email is returned as undeliverable, winner forfeits all right to the prize, and an alternate winner will be chosen. Organization officers, directors, and staff members, and their immediate household or family members are not eligible to enter or win.

Restrictions: Videos and written essays may NOT:

  • Contain material which is (or promotes activities which are) sexually explicit, obscene, pornographic, violent, self-mutilating (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g., underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, or harassing;
  • Include mention or performance of any copyrighted media production including but not limited to music, films, books, television programming, etc., or identifying descriptions of any media property;
  • Contain material that violates or infringes another’s rights, including but not limited to material that violates privacy, publicity or intellectual property rights, or that constitutes copyright infringement. Without limiting the foregoing, video submissions must not include third party trademarks, logos, insignia, location signage, photographs, artwork, or sculptures;
  • Use music that isn’t originally written, performed and produced by the Entrant. All music featured in any video must be available to publicize and broadcast on a license-free, no compensation basis;
  • Include third parties, including but not limited to minors, celebrities and friends who have not expressly authorized the Entrant to display their image, likeness or voice in any submitted video or otherwise use such image, likeness or voice in accordance with these Terms and Conditions.

Entrant Representations: By entering, each Entrant represents and warrants that his or her entry (and the Organization’s and its designees’ use thereof) does not and will not defame or otherwise violate the rights of any third party and does not and will not violate any federal, state, or local laws or ordinances. Entrant further represents and warrants that he or she has secured the requisite consent from any third party referenced or appearing in their entries. To the extent that anyone under the age of 18 appears in a video, Entrant represents and warrants that the minor’s parents consented in writing to the minor’s appearance in the video and the distribution and public display of the video (e.g., on the Organization’s website and social media, YouTube, or other channels).  Entrant (and not the Organization) is solely responsible for securing such written consent and shall not under any circumstances permit any unauthorized minor from appearing in a Contest submission, nor shall Entrant display their likeness or voice or discuss or emulate any of the foregoing in a Contest entry without such written consent. Entrant shall provide any such written consent to the Organization immediately upon request. Failure to comply with this obligation shall immediately disqualify an Entrant from participation in the Contest and, in the case of the Contest winner, result in the forfeiture of the Contest prize. Entrant shall comply with all applicable laws, rules and regulations at all times, including with respect to minors, regardless of any parental or guardian consent.

You also represent and warrant that you are at least 13 years of age to apply or make any submission to the Contest. If you are under age 18, you may not, under any circumstances or for any reason, make any submission to the Contest without the express consent of a parent or other legal guardian. Any such parent or guardian shall be bound by these Terms and Conditions and shall be fully responsible for any such submission and your participation in the Contest. Any reference in this Agreement to “you,” “your” or “Entrant” shall also be deemed to refer to any such parent or guardian.

Rights Granted by Entrant: By entering the Contest, each Entrant understands and agrees that they hereby grant the Organization anyone acting on behalf of the Organization, and the Organization’s licensees, successors, and assigns, a fully paid-up, royalty-free, irrevocable, fully transferable, assignable and sublicensable license and right, where permitted by law, to print, publish, perform, broadcast, display, distribute, reproduce, modify, adapt, edit, truncate, aggregate, create derivative works from, use and otherwise exploit in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, the entry essay and the Entrant’s name, portrait, picture, voice, likeness, image, statements about the Contest and Organization, and biographical information for news, publicity, information, trade, advertising, public relations, promotional, educational, and any other purposes without any further compensation, notice, review, or consent. Any Contest entry or other materials provided by you to the Organization shall remain your exclusive property, subject only to the limited rights granted herein.

By entering the Contest, the Entrant represents and warrants that the entry is an original work of authorship and does not violate any third party’s proprietary or intellectual property rights and that any moral rights therein have been waived. If the entry infringes upon the intellectual property or other right of another, the Entrant will be disqualified at the sole discretion of the Organization.

Personal Information: Other than your entry into the Contest, or as otherwise communicated to you by us in writing, we do not ask for nor do we wish to receive any personal, confidential, secret, or proprietary information or other material from you. You may not provide any personally identifiable information to us, whether with your submission to the Contest or otherwise, except as set forth herein or unless we otherwise mutually agree in writing (and if you are under 18, even then only with the prior written consent of your parent or legal guardian). With respect to any information that you submit (or your parent or legal guardian submits) as part of or in connection with a submission to the Contest or otherwise related solely to the Contest, our information collection and use policies are set forth in these Terms and Conditions and our Privacy Policy, located here.

Third-Party Services: The Contest may involve accessing certain third-party websites, resources, and services, including YouTube or Dropbox. The Organization does not operate or control in any respect, or necessarily endorse, the information, content, products, services, advertising, or other materials that may be found on such third-party websites, resources, and services. These other resources are not under our control, and you acknowledge that we are not responsible or liable for the content, functions, accuracy, legality, appropriateness, or any other aspect of such websites, resources, and services. Your use of these third-party resources is subject to their policies, terms of use and privacy policy and not ours. YouTube’s Terms of Service can be found here. Dropbox’s Terms of Service can be found here. You assume sole responsibility for your use of any third-party websites, resources and services.

Indemnity: If the content of the entry is claimed to constitute infringement of any proprietary, intellectual proprietary or other rights of any third party, the Entrant shall, at the Entrant’s sole expense, defend against or settle such claims. The entrant shall indemnify, defend, and hold harmless the Organization from and against any third party suit, proceeding, claims, liability, loss, damage, costs or expense (including reasonable attorneys’ fees), which the Organization may incur, suffer, or be required to pay (collectively, “Claims”) arising out of (i) such infringement or suspected infringement of any third party’s rights, (ii) any breach of these Terms and Conditions or violation of applicable law, rule, or regulation, including arising out of the appearance, discussion, or emulation of any third person (including any minor, whether authorized by their parent or guardian or not), or their likeness or voice, in any Contest submission, or (iii) any action taken or statement made by Entrant related to the Contest, any Contest submission, any other Entrant, the Organization, or any third party who (or whose likeness or voice) appears or is discussed or emulated in any Contest submission, whether during or after the Contest, regardless of venue, medium, or channel. Any settlement of any Claim is subject to the Organization’s prior written consent.

Waiver, Release and Limitation of Liability: By entering, the Entrant waives any right to sue, and releases and holds harmless, the Organization and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such Entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error in the administration of the Contest or the processing of entries.

Disputes: This Contest is governed by the laws of the United States of America and the State of California, without respect to conflict of laws doctrines. As a condition of participating in this Contest, the Entrant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances shall the Entrant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than Entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Contest). Entrant further waives all rights to have damages multiplied or increased.

Miscellaneous: For clarity, the $2500 Contest prize shall not be deemed “wages” or similar payment under any applicable law, and no Entrant (including the Contest winner) is or shall be deemed to become through participation in the Contest an employee or contractor of the Organization.

All submissions to the Contest, including our acceptance and use of such submissions, are governed by these Terms and Conditions. These Terms and Conditions shall be deemed to incorporate all other notices, policies, disclaimers, and other terms contained in the Organization website, including the Organization’s Terms of Service located here and Privacy Policy located here, provided, however, that in the event of a conflict between such other terms and these Terms and Conditions, these Terms and Conditions shall prevail.
